Landlords and tenants

Landlords and tenants of properties invariably have different approaches to lease covenants and often the tenant's requirements can be demanding and complicated. Our depth of knowledge of lease agreements and technical construction expertise assist the client to achieve a commercially acceptable result.

Dilapidations issues generally arise in leased property when a tenant fails to comply with contractual obligations as set out in the lease, effecting the landlords investment.

We have dealt with all types of property including retail, industrial, offices and residential portfolios. The dilapidations instructions range from small claim values to around £12 million.

Tenant alterations generally require approval under the terms of the lease. We can protect the parties by:

  • Reviewing tenant's proposals for landlord
  • Monitoring tenant's works for landlord
  • Submitting tenant's proposals for tenant
  • Agreeing licence for alterations for landlord or tenant

Condition records are used to limit landlords' and tenants' repairing liabilities in leased property or provide a record to identify any changes to the structure.

Service charges: Guidance from the RICS Code of Practice April 2007 for service charges in commercial property and its aim is to minimise disputes. We have acted for many landlords and tenants to identify the reasonable approach to these works.
